Darden, Fowler & Creighton, L.L.P. represents clients in Conroe, Montgomery County, and throughout Texas in estate planning, probate administration, guardianship proceedings, and trust and estate litigation.
Our attorneys craft comprehensive estate plans that accomplish the objectives of our clients, seek to eliminate or minimize their potential tax liability, provide a plan for the possibility of future incapacity, and avoid the need for probate administration. Our attorneys recognize that every client's situation is unique and tailor estate planning documents to fit their specific needs. Our areas of representation include:
- Statutory Durable Powers of Attorney
- Durable Medical Powers of Attorney
- Directives to Physicians
- Declarations of Guardian
Our attorneys have significant experience in probate administration of both simple and complex estates. We assist clients with probating wills or in the administration of estates where the decedent died without a will ("intestate").
A comprehensive, well-drafted estate plan takes into consideration various contingencies, including the possibility of the future disability or incapacity of an individual. Estate planning documents such as trusts, statutory durable powers of attorney, durable medical powers of attorney, and directives to physicians are designed to provide a plan for the management of one's personal, medical and financial affairs in the event of incapacity.
In the event a person becomes incapacitated, and does not have estate planning documents in place designating who will manage their financial affairs or make decisions regarding their care, our attorneys can assist in obtaining the appointment of a guardian and can advise the guardian regarding their fiduciary duties and obligations. In the event an incapacitated or deceased person has minor children, our attorneys can also assist in obtaining the appointment of a guardian for the children.
Trust, Estate and Probate Litigation
Our attorneys are experienced litigators and are experienced in representing fiduciaries and beneficiaries in connection with trust, estate, and probate disputes. We represent clients in connection with an array of trust and estate issues, including intra-family disputes, challenges to the validity of estate planning documents, allegations of estate mismanagement or breach of fiduciary duty, and claims by beneficiaries.
